These Terms of Service ("Terms") are a binding agreement between you and TheKey Inc. ("TheKey," "we," "us") governing your use of the K-Beauty Picks skin-analysis service (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service analyzes a selfie to estimate cosmetic skin characteristics (such as hydration, visible redness, or visible blemishes) and to suggest skincare products. All results, scores, labels, and recommendations are cosmetic and informational only. They are not medical advice, diagnosis, or treatment, and are not a substitute for professional care. The Service does not diagnose, treat, cure, or prevent any disease or skin condition. Skin estimates are approximate and may be inaccurate. Always seek the advice of a qualified physician or dermatologist with any questions about a medical or skin condition, and never disregard or delay professional medical advice because of something you saw in the Service. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
The Service is intended for adults. You must be 18 years of age or older to use the Service and to receive results by email. By using the Service you represent that you are at least 18. We do not knowingly collect information from anyone under 18.
We recommend third-party skincare products but we do not sell, ship, or fulfill them. Any purchase is a transaction between you and the third-party retailer, subject to that retailer's own terms, pricing, and policies. Prices shown are reference figures (such as MSRP) and may differ from actual retail prices.
As an Amazon Associate, K-Beauty Picks earns from qualifying purchases. Some product links may be affiliate links; if you buy through them, we may earn a commission at no additional cost to you. This does not affect the skin metrics we compute or which products we recommend. The Service, including its software, text, design, and reports, is owned by TheKey Inc. and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for your own personal, non-commercial use. You retain ownership of any selfie you submit; because we do not store your photo, you grant us only a transient license to process it to generate your results, as described in the Privacy Policy.
Our handling of your data — including that your photo is never stored and is discarded immediately after analysis — is described in our Privacy Policy, which is incorporated into these Terms by reference.
The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, TheKey disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that any result, estimate, or recommendation will be accurate, reliable, or suitable for you. Results vary from person to person. Test any new product on a small area first and discontinue use if irritation occurs.
To the fullest extent permitted by law, TheKey Inc. and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility of such damages.
To the fullest extent permitted by law, TheKey's total liability for all claims relating to the service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless TheKey Inc. and its officers, employees, and providers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms or any law or third-party right.
Please read this section carefully. It affects how disputes are resolved.
You and TheKey agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in or near Overland Park, Kansas, or be conducted remotely, at your election where available.
Class-action waiver. Disputes will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing results@ineedlab.com with your name and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Governing law. These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules, except where preempted by the Federal Arbitration Act or other applicable federal law.
We may update these Terms; the effective date above will change when we do. Your continued use of the Service after an update means you accept the revised Terms.
